Terms of Service

These Terms of Service ("Terms") govern your use of Pic Balance (the "Service"), operated by BigHillMedia GbR ("we", "us"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service. The Service is intended for users 13 years of age or older.

1. The Service

The Service lets users upload a photo and share it via a unique link. The recipient sees the photo only after sending a photo of their own. All uploads are automatically deleted within 24 hours. The Service is provided free of charge and may be modified, suspended, or discontinued at any time without notice.

2. Acceptable use — prohibited content

You agree not to upload, transmit, link to, or otherwise make available through the Service any content that:

• is unlawful, infringing, defamatory, fraudulent, threatening, harassing, or invasive of privacy;
• contains pornography, sexually explicit material, nudity, or sexually suggestive content;
• contains, depicts, or sexualizes minors in any way (zero tolerance — CSAM is prohibited and will be reported to NCMEC and law enforcement);
• promotes violence, terrorism, self-harm, hate speech, or harassment of any individual or group;
• depicts illegal drugs, weapons sales, or other criminal activity;
• contains malware, phishing, spam, or unsolicited commercial content;
• impersonates another person or violates publicity, privacy, or intellectual-property rights;
• depicts identifiable individuals without their consent.

We may remove any content and block any user at any time, at our sole discretion, without notice or liability. You are solely responsible for the content you upload.

3. Your representations

You represent and warrant that you own or have all necessary rights and consents to upload the content and that doing so does not violate any law or third-party right.

4. License you grant us

You grant BigHillMedia GbR a limited, worldwide, royalty-free license to host, store, transmit and display the content solely to operate the Service. This license ends when the content is deleted (no later than 24 hours after upload).

5. DMCA / copyright

If you believe content infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to notify@picbalance.com. We may remove the content and terminate repeat infringers.

6. Disclaimer — no warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT CONTENT WILL BE SECURE, RETAINED, OR DELIVERED.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIGHILLMEDIA GBR AND ITS PARTNERS, PRINCIPALS, AGENTS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED USD 50.

8. Indemnification

You agree to defend, indemnify and hold harmless BigHillMedia GbR and its partners, agents and employees from any claim, liability, damage, loss or expense (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms.

9. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice or liability.

10. Governing law & venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. You and we each waive any right to a jury trial. Class actions are not permitted; disputes may be brought only in an individual capacity.

11. Changes

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance.
